State RERA Authority
RERA Complaint Letter — Builder Delay & Possession Issues
Builder delaying possession by months or years? Promised amenities missing? Refusing to refund despite the agreement clause? RERA (Real Estate Regulatory Authority) is your direct route — and it's binding. Nyaykar drafts a state-specific RERA complaint letter in 60 seconds.
How to file a State RERA Authority complaint
Find your project's RERA registration
Every RERA-registered project has a unique RERA ID (e.g. MahaRERA P52100012345). Get it from your sale agreement or the state RERA portal. You cannot file a RERA complaint without this number.
Send a written notice to the builder
Email the builder a clear written notice citing the agreement clause they breached (delay, missing amenities, refund). Give them a deadline (usually 15-30 days). This is your evidence the builder ignored you.
Generate the RERA letter with Nyaykar
Tell Nyaykar your project, RERA ID, what was promised in the agreement, and what's missing. The AI drafts a formal complaint citing the relevant section of the Real Estate (Regulation and Development) Act, 2016.
File on your state RERA portal
Each state has its own portal — MahaRERA (Maharashtra), RERA Karnataka, UP RERA, Tamil Nadu RERA, etc. Pay the RERA filing fee (₹5,000 for residential complaints in most states). Attach the agreement, payment receipts, and Nyaykar's letter.
Hearing and binding order
RERA usually takes 60-90 days. They can order the builder to (a) deliver possession, (b) pay interest at SBI MCLR + 2% on the amount paid, or (c) refund with interest. RERA orders are binding — non-compliance is a criminal offence.

Frequently asked questions
- How much does it cost to file a RERA complaint?
- Most states charge ₹5,000 for residential complaints. Commercial properties: ₹10,000. The fee is small compared to the interest + refund relief RERA can order.
- How long does the builder have to respond to RERA?
- Builder must file a reply within the time RERA gives (usually 15-30 days). RERA then conducts hearings and issues a binding order, typically within 60-90 days of filing.
- Builder is offering possession but the project is incomplete — should I take it?
- Don't accept possession in writing if amenities are missing or there are major construction defects. Once you accept (sign the possession letter), your claim weakens. File a RERA complaint citing 'incomplete possession' and the specific clauses breached.
- Project is not RERA-registered — what now?
- Selling un-registered RERA-mandatory projects is itself a criminal offence. File directly at the state RERA Authority and also at the District Consumer Commission. Compensation in such cases is typically higher because of the regulatory breach.
- Builder went bankrupt — can RERA help?
- Yes initially, but if the builder is in IBC (Insolvency and Bankruptcy Code) proceedings, your case moves to NCLT. RERA can record your claim and direct refund, but execution depends on the IBC resolution. File at both.
- What's the difference between RERA and a Consumer Commission?
- RERA is real-estate-specific, faster (60-90 days), and binding. Consumer Commission handles all consumer issues, slower, allows larger compensation. Most home buyers file RERA first; if RERA's relief is unsatisfactory, escalate to NCDRC.
